Terms of Service

1. Acceptance

By accessing or using GarageDesk ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

GarageDesk provides an AI-powered front-desk assistant that answers customer questions, books appointments, and captures leads for independent auto repair shops via a website chat widget and voice interface.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By creating an account, you represent that the information you provide is accurate.

4. Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• Notify us immediately at support@garagedesk.app if you suspect unauthorized access.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to reverse-engineer, decompile, or extract source code.
• Resell or redistribute access to the Service without written permission.
• Upload malicious content or use the Service to spam end users.

6. Subscription & Payments

• Paid plans are billed monthly or annually as selected at checkout.
• Payments are processed by Stripe. You agree to Stripe's terms of service.
• Subscriptions renew automatically. You may cancel at any time from your dashboard; access continues until the end of the billing period.
• Refunds are handled on a case-by-case basis. Contact support within 14 days of charge.

7. Intellectual Property

All content, trademarks, and technology comprising the Service are owned by GarageDesk. You retain ownership of the data you upload. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service.

8. AI-Generated Content

GarageDesk uses AI to generate responses on behalf of your shop. While we strive for accuracy, AI responses may occasionally be incorrect. You are responsible for reviewing and configuring the assistant's knowledge base. GarageDesk is not liable for actions taken based on AI-generated content.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, GarageDesk shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless GarageDesk from claims arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account for violation of these Terms. You may delete your account at any time by contacting support.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

14. Changes

We may modify these Terms at any time. Continued use after changes constitutes acceptance. We will notify you of material changes via email.
